PRIVACY POLICY AND COOKIES

Motorent Sp. Z o.o. seated in Warsaw (KRS number 0000037337, furtherly known as “Motorent”) as the exclusive licencee of Hertz Intl in Poland and the owner of the oferty.hertzpoland.pl website reserve rights to introduce shifts into the Privacy Policy. Any user of the Website is bound with the current Privacy Policy. Any shifts introduced shall not violate the following rule: Motorent does not sell or share personal or address data of the Clients or Users to the third parties . If you do not agree with the Privacy Policy, please do not visit the Website.

The following Policy is effective on 30.03.2023.

        I.             General information

    1. The operator of the Website oferty.hertzpoland.pl is Motorent.
    2. The Website fulfils its function of sourcing of information about users and their behavior in a following manner:
      1. Through information voluntarily quoted into the forms.
      2. Through saving cookie files in the end devices.
      3. Through the collection of server logs via Motorent’s hosting operator that operates under the www address: oferty.hertzpoland.pl
    3. The Website collects information quoted voluntarily by the User.
    4. The Website is allowed to also save information about the parameters of the internet connection (timestamp, IP address).
    5. Data quoted in the form may me considered as personal data. In such case, Motorent as the administrative entity of these personal data assures that their processing shall be conducted in accordance with the effective laws and industry’s best practices and standards.     6. Data provided in the form are processed for purposes stemming from the function of particular forms, for instance, to complete the process of servicing of the maintenance request  or commercial contact.
    7. Data quoted in forms may be conveyed to the entities providing some of the services in a technical manner, which in particular involves conveying information about the owner of the domain registered to the entities being the operators of the domains, websites servicing the payments and other entities, with which Motorent cooperates.
    8. Motorent may be obliged to share information collected through the Website with the authorized entities on the basis of demands remaining in accordance with law and in the scope of the demand.

 

      II.             Cookie files

    1. The Website employs cookie files.
    2. Cookie files are IT-related data, especially of textual character, which are stored in the end device of the Website User and are intended for the usage of Website’s pages. Cookies usually contain the name of the webpage, from which they originate, the time of their storage in the end device and a unique number.
    3. The entity that applies cookie files to the User’s end device and that receives the access to them is the operator of the Website.
    4. Cookie files are used for the following purposes:
      1. to create statistics, which help in understanding of how the Users use web pages, which allows improvement of their structure and content;
      2. to sustain Website User’s session (after logging in), thanks to which the User shall not have to quote the login and the password repeatedly on each page;

      3. the name of the client’s station – identification issued by the HTTP protocol,

    16. The data are subject to external entities only within the premises of law.

    III.             Personal data processing

1.       Motorent processes the personal data of the Users in some of the following cases:

a.       If the User reaches out directly to Motorent, e.g. through the web page or the Website;

b.       if the User buys a product or a service directly from Motorent or through third parties;

c.       if the personal data of the User are conveyed by the third parties when it is within the premises of law;

2.       The scope of the personal data Motorent processes depends on the character of the relations binding the entities. Detailed information may be obtained by contacting Motorent. The following data might be collected in particular:

a.        Identifiying/authorization data;

b.        contact data;

c.       data regarding the vehicle preferred;

d.        location data;

e.       data regarding the Website’s usage;

3.       Motorent can process the personal data of the Users:

a.       for the purposes of the completion of the agreement or to initiate actions leading to the agreement signing on User’s demand, in particular in case of the aim of usage or to use the products and services offered by Motorent (based on act 6/1 GDPR)

b.       for marketing purposes, in case of User’s stating a separate agreement (act 6/1 GDPR). The marketing agreement might be withdrawn at any time with regard to future arrangements, the User might also oppose the data processing for the marketing purposes directly;

c.       for the purposes of completing by Motorent the duties stemming from the universally effective laws (act 6/1 GDPR).

d.        dla celów wynikających z prawnie uzasadnionych interesów Motorent, polegających na zapewnieniu dostępu do Serwisu i możliwości korzystania z niego oraz świadczonych przez Motorent usługo; kontakcie bieżącym dotyczącym zamówień, wniosków, reklamacji i innych relacji z Motorent. W uzasadnionych przypadkach dane mogą być w tym zakresie przetwarzane także na potrzeby archiwizacji oraz ustalenia, dochodzenia lub obrony przed roszczeniami. Podstawą przetwarzania danych osobowych w tym przypadku jest art. 6 ust. 1 lit. f RODO.

4.       The cope of entities, with which the personal data of Users shall be shared or authorized to be processed depends on the character of the binding relations. Detailed information might be obtained by the User by contacting Motorent.

5.       Personal data might be conveyed to other entities provided that there are legal norms regulating such act.

6.       Personal data can be conveyed to the following entities in particular:

a.       Partnerships bound in terms of law, capital or persons with Motorent;

b.        Motorent’s commercial partners;

c.       Partnerships supplying services to Motorent.

7.       Motorent may convey the personal data of the Users to the entities outside the European Economic Area.

8.       Such transfer is performed into countries that have been recognized by the European Commission as providing sufficient level of protection based on decisions. In case such decision has not been made the data transfer is protected by us on the basis of agreements made through standard clauses or binding corporate rules. 9.       The personal data that are processed may be shared by Motorent for the use of Motorent International Ltd 8501 Williams Road Estero, FL 33928, Stany Zjednoczone (“Motorent Intl”) for the sake of the usage of unified rental servicing system that is maintained by servers placed within the private premises of Motorent Intl, which means some of the data essential for the supply of the service is automatically integrated with systems of reservation and reckoning of the rental. The exchange of data between Motorent and Motorent Intl shall take place on the basis of inside corporate procedures adjusted to the requirements stemming from the GDPR.

10.   The personal data of users shall not be any basis to the automated process of decision-making.

11.   Motorent stores the personal data only throughout the period essential for completion of the aim, to which the data have been originally sourced, no longer than until the expiration of mutual claims between Motorent and the User. 12.   In terms of and based on rules determined in articles 15-21 of GDPR the Users are attributed with:

a.       the right to access their personal data and obtain their copies (article 15 of GDPR)

b.       right to correct their personal data or their fulfilment (article 16 of GDPR);

c.       right to demand the deletion of the personal data (article 17 of GDPR);

d.       right to demand limitations to your personal data processing (article 18 of GDPR);

e.       right to transfer of your data (article 20 GDPR);

f.         right to submit objections to your personal data processing (article 21 of GDPR);

13.   The User is also attributed with the right to submit a complaint to the President of the Personal Data Protection Office.
